"When a motor vehicle and a bicycle are traveling in the same direction on any highway, street or road, the operator of the motor vehicle overtaking such bicycle traveling on the right side of the roadway shall not turn to the right in front of the bicycle at the intersection of at any alley or driveway until such vehicle has overtaken and is safely clear of the bicycle."
Municipal Code of Chicago, 9-16-020(f)

If you have been hit by a car while riding a bicycle, we can help.  Injured bike riders often need an experienced attorney to deal with skeptical insurance adjusters.  Chicago Accident Lawyer Steven A. Sigmond has experience and offers free consultations to injured bike riders.

In Chicago, many dedicated bike lanes have been opened on the city streets in recent years.   The city actively encourages commuters to consider bicycle riding for both recreation and for primary transportation.  The City of Chicago has also enacted ordinances to protect the rights of bike riders.

Chicago Ordinance 9-16-020 states that the driver of a car must wait until he is clear of a bicycle before turning right.  In other words, the bike rider going straight has the right of way.

The State of Illinois Motor Vehicle Code also contains statutory protection for bike riders.  For example, Section 11-1407 prohibits opening a car door into a traffic lane until it is safe to do so.

Despite the emphasis on bike rider safety and rights, many bike rider injuries continue to occur.  Worse yet, some insurance adjusters continue to deny liability for bike rider injuries in the very situations covered by these statutes.  Injured bike riders should get appropriate legal advice as soon as possible.
